Terms of Service
Last updated October 4, 2026
These terms are an agreement between you and OpenOpp LLC (“OpenOpp,” “we” or “us”), a Colorado limited liability company, and cover your use of open-opp.com and the OpenOpp service. By creating an account, RSVPing, signing in at an open house or otherwise using OpenOpp, you agree to these terms and to our Privacy Policy.
1. What OpenOpp is
OpenOpp is a software platform that helps real estate agents schedule, host and promote open houses, and helps home buyers find and RSVP to them. OpenOpp is not a real estate brokerage. We do not represent buyers or sellers, give real estate, legal or financial advice, or take part in any transaction. Agents, their brokerages and their clients are responsible for the real estate services they provide.
2. Accounts
- You must be at least 18 years old and give accurate information, including your name, email and phone number.
- Agent accounts are for real estate brokers who hold an active Colorado license. We may verify your license and may suspend agent features if it can’t be verified or becomes inactive.
- Assistant accounts act for agents who have invited or authorized them. An assistant is responsible for following that agent’s instructions, and the agent remains responsible for their listings.
- Keep your password private. You’re responsible for activity on your account.
3. Listings and open houses
If you post a listing, add an open house or host one, you confirm that:
- You have the seller’s and, where required, your brokerage’s authorization to market the property and hold the open house, and, if you add an open house for another agent’s listing, that agent’s permission.
- The listing is active in the MLS before it is advertised to the public, consistent with your MLS’s rules, including any Clear Cooperation policy. Listings without an MLS number are shown only to agents at the listing agent’s brokerage, and can’t be opened to other brokerages until they have one. Your brokerage on OpenOpp must be the brokerage that holds your license.
- The information you enter is accurate, and you’ll update or remove it when it changes.
- You’ll follow Colorado real estate law, your brokerage’s policies, MLS rules and fair housing laws.
- You’ll keep lockbox codes, access instructions and host notes confidential and use them only to host the open house.
Host incentives. A listing agent may offer a host an incentive, such as a gift card or event tickets. Incentives are an arrangement between those agents. The listing agent provides it directly. OpenOpp doesn’t hold, pay, guarantee or enforce incentives and isn’t responsible if one isn’t provided. Each agent is responsible for following their brokerage’s policies and Colorado law on compensation. An incentive can’t be changed once a host claims the date, though either agent can still cancel or release it.
Hosts are independent agents. OpenOpp does not employ, supervise or guarantee any agent, and is not responsible for what happens at a property or an open house. Listing agents and hosts should follow their own safety and brokerage procedures.
4. Photos and other content
You keep ownership of the photos, text and other content you add. You confirm you own it or have permission to use it (for example, a photographer’s license to market the listing), and you give OpenOpp a non-exclusive, royalty-free license to host, display and share it on OpenOpp and on the share pages, flyers and sign-in pages it creates, for as long as it is on the service. We may remove content that we believe breaks these terms or someone else’s rights.
5. Leads, RSVPs and sign-ins
- When a buyer RSVPs or signs in, their information is shared with the agents hosting that open house (or the listing agent, if no one else is hosting), as shown on the form. The listing agent sees how many RSVPs an open house has, not who they are.
- Agents who receive leads are responsible for contacting people lawfully, including under the Telephone Consumer Protection Act, CAN-SPAM and Colorado law, and for honoring requests to stop.
- Hosts receive RSVP leads on every plan. The door sign-in page, QR sign-in and lead tools such as the spreadsheet download are part of Pro.
- Visitors can sign in without agreeing to be contacted, and agents must honor that choice. Agents may not solicit visitors who say they are working with another agent.
- Answers to the seller feedback questions are shared with the listing agent without names or contact details.
6. Texts and emails
If you choose to receive texts, you agree to automated text messages from OpenOpp about open houses you’re involved in and, if you choose, new open houses in your areas. Message frequency varies. Message and data rates may apply. Reply STOP to cancel or HELP for help. Consent isn’t required to use OpenOpp. You can change text and email settings on your Profile page at any time. Carriers aren’t liable for delayed or undelivered messages.
7. Plans and billing
- OpenOpp offers a Free plan and a paid Pro plan. Brokerages may cover Pro for their agents under a separate partner agreement.
- Pro is billed in advance each month (or year, if offered) until you cancel. Prices are shown on our site and may change with at least 30 days’ notice.
- You can cancel any time; Pro features continue until the end of the paid period. Payments are non-refundable except where the law requires otherwise.
- If a payment fails or your brokerage partnership ends, your account moves to the Free plan.
8. Things you may not do
- Post false, misleading or discriminatory content, or listings you aren’t authorized to market.
- Use buyer information for anything other than following up about real estate, or sell or share it with others.
- Send spam, scrape the site, interfere with its security, or access accounts or data that aren’t yours.
- Impersonate another person, agent or brokerage.
9. Suspension and closing your account
You can close your account at any time by emailing info@open-opp.com. We may suspend or close an account that breaks these terms, puts others at risk, or can’t be verified. Sections that by their nature should survive (such as content licenses already used, disclaimers and limits of liability) continue after an account closes.
10. Disclaimers
OpenOpp is provided “as is” and “as available.” Listing and open house information comes from agents and may contain errors; it is deemed reliable but not guaranteed. To the fullest extent the law allows, we disclaim all warranties, including merchantability, fitness for a particular purpose and non-infringement, and we don’t promise the service will be uninterrupted or error-free, or that any open house will be hosted or attended.
11. Limit of liability
To the fullest extent the law allows, OpenOpp will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, commissions, data or business, arising from your use of the service. Our total liability for any claim is limited to the greater of the amount you paid OpenOpp in the 12 months before the claim or $100.
12. Indemnity
You agree to defend and hold harmless OpenOpp and its members and contractors from claims arising from your listings, open houses, content, use of leads, or breach of these terms.
13. Governing law
These terms are governed by the laws of the State of Colorado. Any dispute will be handled in the state or federal courts located in Denver, Colorado, and you and OpenOpp agree to that jurisdiction.
14. Changes
We may update these terms. If a change is significant, we’ll let you know by email or in the app before it takes effect. Continuing to use OpenOpp after that means you accept the updated terms.
15. Trademarks
OpenOpp™ and the OpenOpp door logo are trademarks of OpenOpp LLC. You may not use them without our written permission, except to refer to the service.
